Rethinking Privacy in the AI Era

This white paper presents a comprehensive examination of the intersection between artificial intelligence (AI) and privacy regulations. It outlines the increasing demand for data in AI development and the associated risks to individual and societal privacy. The authors argue that existing privacy and data protection laws are insufficient to address the unique challenges posed by AI, particularly concerning data acquisition and governance. They discuss the implications of current regulatory frameworks, including the Fair Information Practices (FIPs) and the General Data Protection Regulation (GDPR), and highlight the limitations of these frameworks in mitigating privacy harms. The paper also offers three suggestions for improving data privacy in the context of AI: shifting to an opt-in data collection model, enhancing transparency and accountability in the AI data supply chain, and developing new governance mechanisms to support individual data rights.
